General Terms and Conditions for the BRITA Online Shop
1. Scope of application and delivery restrictions
1. All contracts for the sale of goods between BRITA SE, Heinz-Hankammer-Str.1, 65232 Taunusstein, Germany, telephone: +49 6128 / 746-0, fax: +49 6128 / 746-5033 (hereinafter "BRITA") and the customer shall be governed exclusively by these General Terms and Conditions (hereinafter "GTC").
2. Customers within the meaning of these GTC may be both consumers as well as traders (hereinafter "Customer"). “Consumer” is an individual acting for purposes which are wholly or mainly outside that individual’s trade, business, craft or profession. “Trader” is a person acting for purposes relating to that person’s trade, business, craft or profession, whether acting personally or through another person acting in the trader’s name or on the trader’s behalf.
3. BRITA will only supply Customers who provide a delivery address in the United Kingdom.
4. If and insofar customers wish to redeem a promotional voucher or subscribe to a recurring subscription as part of their order, the following supplementary terms and conditions shall apply in addition to these GTC, as applicable:
A. Additional Terms and Conditions for the Redemption of Promotional Vouchers;
B. Additional Terms and Conditions for the Interval Subscription.
2. Conclusion of contract
1. The presentation and promotion of goods in the BRITA online shop does not constitute a binding offer to conclude a purchase contract, but merely an invitation to the Customer to make an offer (place an order). All information is therefore subject to change and non-binding.
2. Customers may use the online shop as a guest without registering, or may set up a personal user account ('MyBRITA account') via the online shop.
The purchase contract is concluded upon submission of an order by the Customer (offer) and subsequent acceptance by BRITA. After the order has been submitted, BRITA shall immediately send the Customer an automatic email confirming receipt of the order and listing the details of the order (order acknowledgment), which the Customer can save permanently and print out. This order acknowledgment merely documents that BRITA has received the Customer's order and does not, by itself, constitute acceptance of the Customer's offer. The contract between the Customer and BRITA is only concluded upon dispatch of the order confirmation. The order confirmation contains the terms of the contract, including a link to the BRITA website where these GTC and the withdrawal policy can be downloaded, and is usually sent together with the dispatch confirmation.
The GTC and the Withdrawal Policy are made available on the BRITA website (https://www.brita.co.uk/terms-and-conditions) and can also be accessed there in PDF format in a manner that allows customers to download, save and print them before placing an order and at the time the contract is concluded.
3. BRITA may refuse to conclude a contract with the Customer.
4. The Customer can place an order by performing the following steps:
1. selecting items from the BRITA range in the online shop and adding them to the shopping basket using the 'Add to cart' button;
2. accessing an overview of the intended order by clicking the 'Basket' button or icon; in this overview, the Customer can check and amend the selected products, their quantities, the delivery address and the payment method, and may identify and correct input errors (e.g. as to product selection, quantities, or delivery or billing address) at any time before submitting the order, by clicking the 'Back' button, amending the relevant input fields, or removing items from the shopping basket;
3. immediately before submitting the order, reviewing the order summary page, on which the key characteristics of the goods, the total price including all taxes and duties, any postage and delivery costs, and the delivery time are displayed clearly and prominently;
4. placing a binding order to purchase the goods in the shopping basket by clicking the "Pay now" button. Before clicking this button, the Customer is required to tick the relevant box to confirm their agreement to these GTC, including the withdrawal policy, and to confirm that they have read the privacy policy. It is not possible to submit the order without confirming this agreement and acknowledging the privacy policy.
5. Following the conclusion of the contract, BRITA stores the terms of the contract for internal purposes; Customers who have a MyBRITA account can access these in their MyBRITA account. As part of the order confirmation, Customers will receive an overview of the goods ordered and the total price, including all taxes and charges. A separate invoice will be provided to Customers in electronic form on request via customer service, and Customers agree to receive invoices exclusively in electronic form. If Customers have set up a MyBRITA account, they also have the option of viewing their order details online.
3. Right to cancel Distance ContractsIf the customer is a Consumer, he/she shall be entitled to a right to cancel as set out in this section, provided a distance contract has been concluded.
1. You have a legal right to change your mind and cancel the contract between you and us within 14 days of delivery of your products without giving a reason. This right, under the Consumer Contracts (Information, Cancellation and Charges) Regulations 2013, is explained in more detail below. Please note that the right to change your mind does not apply to any bespoke products you purchase from us (i.e. products that we create to your specification or are clearly personalised) or goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been broken after delivery.
2. Where products are sold as a set item (i.e. a pre-packaged set sold exclusively as a single unit, the components of which are not available separately, and marked accordingly in our online shop), the set may only be returned in its entirety. Returning individual components of a set item is not possible, and cancellation is only valid if all components of the set are returned together.
3. The cancellation period will expire 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the products. You may cancel the contract in respect of all products delivered or in respect of certain of the products only. Where you order multiple products in one order or a product is delivered in separate parts, lots or pieces, the cancellation period will expire 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last product, part, lot or piece that makes up your order.
4. To exercise the right to cancel, you must inform us of your decision to cancel the contract with us by making a clear statement (e.g. a letter sent by post or email). The easiest way to do this is to contact our Customer Services team, BRITA SE, Heinz-Hankammer-Str. 1, 65232 Taunusstein, Germany, Tel: 0800 279 4145, email: shop@brita.net. You may use the model cancellation form provided in section 4 of these GTC but you are not required to do so.
5. To meet the cancellation deadline, it is sufficient for you to send your communication concerning the exercise of your right to cancel before the cancellation period has expired.
6. We will send you an acknowledgement of receipt of your notice to cancel by email.
7. If you cancel the contract with us, we will reimburse you all payments received from you, including the cost of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us and for any deductions permitted under clause 3.11).
8. We will make the reimbursement without undue delay, and not later than:
a) 14 days after the day we receive back from you any products supplied;
b) (if earlier) 14 days after the day you provide evidence that you have returned the products; or
c) if there were no products supplied, 14 days after the day on which we are informed about your decision to cancel this contract.
9. We may withhold reimbursement until we have received the products back or you have supplied evidence of having sent back the products, whichever is the earliest.
10. We may make a deduction from the reimbursement for loss in value of any products supplied, if the loss is the result of unnecessary handling by you. You are only liable for any diminished value of the products resulting from the unfair and/or unreasonable wear and tear of the products other than what is necessary to establish the nature, characteristics and functioning of the products. We may make a deduction from any reimbursement (you are entitled to from us) for such loss in value of any products we supply.
How to return products
11. If you wish to exercise your rights to a refund under this clause 3, you must return those products to the following address: Wonderpack (ECO3), Unit 10, Blenheim Park Rd, Nottingham NG6 8YP. We will pay the costs of return if the products are faulty or misdescribed in accordance with clause 3.15. In all other circumstances, you must pay the costs of return.
12. You are responsible for taking reasonable care of the products until they are returned to us. We recommend that you register your return through the Returns Portal (https://brita-dtc-uk.ecommercereturns.io, follow the instructions provided there, )and that you keep proof of postage. We will be unable to provide you with a full refund if the products are not returned to us or if they are damaged when they arrive.
Refund payments
13. We will make the reimbursement using the same means of payment as you used for the initial transaction; you will not incur any fees as a result of the reimbursement.
Other refunds
14. You have legal rights in relation to products that are not as described, faulty or otherwise not fit for purpose. If you believe that any products that you have ordered do not conform with these GTC, please contact our Customer Services Team to request a replacement or refund.
15. If, due to unforeseen circumstances, we are unable to fulfil your order or any of the products in a particular order, we will refund the value of the product(s) that we were unable to fulfil and, if the full order is cancelled, any delivery charges. You may obtain a refund by contacting us.

Address of consumer(s),

5. Delivery and shipping costs
The following paragraphs 1 to 2 apply to Consumer customers only.
1. Delivery takes place within the delivery time specified on the relevant product page. Unless a different delivery time is stated on the product page, the delivery period is approx. 1-2 business days from the conclusion of the contract. The delivery period begins on the day after the contract is concluded (provided the purchase price has been paid in advance, where applicable) and ends at the end of the last day of the period.
2. If, at the time the Customer places their order, the product selected by the Customer is not available, BRITA will inform the Customer of this without delay. If the product is permanently out of stock, BRITA will refrain from accepting the order, and in this case no contract is formed.
3. Unless otherwise agreed, the Customer shall bear the shipping costs indicated on the web pages. When ordering via the BRITA online shop, the shipping costs are indicated both on the web pages and in the shopping basket. The costs for a specific shipping method or special packaging requested by the Customer shall be borne by the Customer.
4. BRITA reserves the right to make partial deliveries unless this is unreasonable for the Customer. Additional shipping and packaging costs arising from partial deliveries shall be borne by BRITA.
5. If BRITA is in default, BRITA shall set a further grace period of not less than 14 days for delivery. If BRITA does not deliver within that grace period, the Customer shall be entitled to cancel the contract.
6. BRITA is entitled to withdraw if a supplier of BRITA breaches its contractual obligation and does not supply BRITA with the ordered goods. In this case, BRITA shall inform the Customer immediately of the non-availability of the ordered goods and reimburse any counter-performance already rendered by the Customer without delay.
6. Prices and terms of payment
The following paragraphs 1 to 6 apply to Consumer customers only.
1. All prices stated in the BRITA online shop, in the e-mail order confirmation, in the shipping confirmation or elsewhere are inclusive of the respective applicable British value added tax. If an increase in value added tax comes into force after the Customer's order (submission of the offer), this shall not affect the costs to be paid by the Customer. Any customs duties incurred shall be borne by the Customer.
2. The Customer may select a payment method from the list of payment methods. The payment methods offered include Apple Pay, Google Pay, PayPal Express, credit card (VISA, MasterCard and American Express) and Klarna.
3. Where a credit card (VISA, MasterCard or American Express) or Klarna has been selected as the payment method, BRITA hereby informs Customers that payment processing is handled by the payment service provider Shopify International Limited, 2nd Floor, Victoria Buildings, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland ('Shopify'). Customers are informed of the individual payment methods offered via Shopify in the BRITA online shop. To process payments, Shopify may use additional payment services, to which specific payment terms and conditions may apply; Customers may be notified of these separately where applicable.
4. Where an instant payment system (e.g. Klarna) has been selected as the payment method by clicking on the payment service provider's icon, Customers will be redirected either to the order summary page or to the relevant website of the provider of the instant payment system. There, they must then make the relevant selection or enter their personal details.
5. If PayPal Express has been selected as the payment method by clicking on the payment service provider's icon, Customers will be redirected either to the order summary page or to the relevant website of the respective provider. There, they must then make the appropriate selection or enter their personal details.
6. For payments from outside the United Kingdom, Customers must bear all additional charges levied by their own payment service provider for processing the payment, including any charges for currency conversion. BRITA shall bear the charges of its own payment service provider. Payments must be made in pounds sterling (GBP).
If you are a Consumer, paragraphs 7 to 9 do not apply to you and no fees will be charged for late payments:
7. In order to hedge the credit risk, BRITA reserves the right to make the delivery of the ordered goods dependent on advance payment in individual cases.
8. Unless otherwise stated in the order, the order confirmation, the shipping confirmation or elsewhere, the remuneration owed by the Customer shall be due without deduction upon delivery of the goods to the Customer. If the Customer fails to pay an invoice within 30 days of the due date and receipt of the invoice, BRITA is entitled—without prejudice to any other claims—to charge annual interest on arrears at a rate of five percentage points above the base rate applicable at the time. BRITA expressly reserves the right to assert further damages.
9. For the first demand for payment (first reminder) (unless the Customer only formally falls into arrears with this demand for payment/reminder) a fee of GBP 2.00 will be charged; for the second demand for payment (second reminder) a fee of GBP 4.00 will be charged. Each party shall be at liberty to prove higher or lower costs.
7. Retention of title
1. Title in the products comprised in your order shall remain with BRITA until we have received payment in full for those products. Risk in the products passes to you on delivery.
2. If you are a Consumer, this paragraph does not apply to you: If the Trader Customer does not pay the amount owed in full, BRITA is entitled to withdraw from the contract after the setting and unsuccessful expiry of a reasonable period of grace. In the event of withdrawal, BRITA shall take back the goods and, if necessary, demand that the Customer assign to BRITA all claims against third parties for surrender of the goods.
8. Material defects
1. BRITA warrants in accordance with the following provisions that all delivered goods shall be free of material defects at the time of transfer of risk.
2. BRITA shall remedy material defects within a reasonable period of time (subsequent performance), either by eliminating the defect (rectification) or by delivering an item free of defects (replacement delivery). If subsequent performance fails, is unreasonable for the Customer or is refused by BRITA—or is justified for other reasons after weighing up the interests of both parties—the Customer shall be entitled, without restriction, to the statutory rights of withdrawal or reduction and, if applicable, compensation for damages and expenses. However, there shall be no right of withdrawal if the defect is merely an insignificant material defect.
3. BRITA's liability shall not apply if the Customer modifies the goods themselves or has them modified by third parties without BRITA's consent, unless the Customer proves that the material defects in question have not been caused either wholly or in part by the modification and that the modification does not make subsequent performance more difficult.
4. BRITA shall not be liable for defects arising from normal wear and tear, external factors or improper use.
9. Liability
1. Nothing in these GTC excludes or limits our liability for:
a) death or personal injury caused by our negligence;
b) fraud or fraudulent misrepresentation; and
c) any matter in respect of which it would be unlawful for us to exclude or restrict our liability.
If you are a Trader:
2. If you are acting for purposes relating to your trade, business, craft or profession, then subject to clause 9.1:
a) in no event shall we be liable to you for any loss of profits, loss of revenue, loss of contracts, failure to realise anticipated savings or for any indirect or consequential loss, whether arising from negligence, breach of contract or otherwise; and
b) our total liability to you for any loss or damage arising out of or in connection with these GTC, whether in contract (including under any indemnity), tort (including negligence) or otherwise shall be limited to the total price of your order.
If you are a Consumer:
3. If you are acting for purposes that are wholly or mainly outside of your trade, business, craft or profession then, save as set out in clause 9.1, the following sub-clauses apply:
a) If we fail to comply with these GTC, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these GTC or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time that you purchased a product from us.
b) Nothing in these GTC affects your statutory rights. Advice about your statutory rights is available from your local Citizens' Advice Bureau or Trading Standards Office.
c) You agree not to use the products for any commercial or business purposes and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
d) Our total liability to you for any loss or damage arising out of or in connection with these GTC, whether in contract (including under any indemnity), tort (including negligence) or otherwise shall be limited to the total price of your order.
10. Statute of limitations
1. The Customer's claims for subsequent performance and damages due to a defect shall become time-barred—except in cases of fraud—within six (6) years from delivery of the respective goods to the Customer. The exercise of a right to withdraw from the contract or to reduce the remuneration shall be excluded if the Customer's claim for performance or subsequent performance is already time-barred. Nothing in this clause shall operate to reduce or exclude any limitation period to which a Consumer is entitled under applicable law.
2. Claims of the Customer based on a breach of duty other than a defect shall become time-barred - except in cases of fraud - within six (6) years of the claim arising. Claims for damages due to personal injury shall become time-barred within three (3) years of the date on which the cause of action accrued or, if later, the date of knowledge of the person injured.
11. BRITA "money-back guarantee"
1. BRITA grants a voluntary "money-back guarantee" for correspondingly marked products in the BRITA online shop. The "money-back guarantee" is a voluntary commercial arrangement offered by BRITA and constitutes an extended refund right only. It does not constitute a "guarantee" within the meaning of the Consumer Rights Act 2015. This clause is in addition to, and does not affect, a Consumer's statutory rights, including (without limitation) the right of withdrawal set out in clause 3 above and any rights under the Consumer Rights Act 2015.
2. The Customer is entitled to return goods covered by the "money-back guarantee" to BRITA within 30 days without stating reasons. The 30-day period begins with the receipt of the goods by the Customer. The timely dispatch of the goods shall be sufficient to meet the deadline.
3. The Customer shall bear the risk associated with the return. In all other respects, clause 3 above on the right of withdrawal shall apply mutatis mutandis to return shipping and the assumption of the costs thereof.
4. The Customer is not obliged to pay compensation for any deterioration in value caused by the intended use of the goods that are covered by the money-back guarantee. If and insofar as the Customer has already made a payment (i.e. purchase price and shipping costs) for the returned goods, BRITA shall refund this payment within 30 days. If the Customer returns only some of the purchased goods and if these goods fall under the "money-back guarantee" and were ordered by the Customer as individual goods of an order comprising several goods, BRITA shall refund the purchase price of the returned goods and the corresponding share of the shipping costs.
12. Set-off / Retention / Assignment
1. Please note that this section does not apply to Consumer Customers. The Customer may only offset their own claims if these claims have been legally established, are undisputed or acknowledged. There shall be no right of retention if this is based on claims arising from another contractual relationship. If the Customer is a consumer, the right to set off a claim they have against BRITA against a claim of BRITA against this Customer/consumer shall not be restricted or excluded.
2. If the Customer is a Trader, claims against BRITA cannot be assigned.
13. Data Access and Use
We process your personal data in accordance with our Privacy Policy (https://www.brita.co.uk/privacy-policy]). Further information on how we collect, use, store and protect your personal data can be found in our Privacy Policy.
This clause sets out how BRITA and the Customer may access and use data generated through the use of the products or related services. Nothing in this clause affects the Customer's rights under applicable data protection legislation, including the UK General Data Protection Regulation and the Data Protection Act 2018.
Certain provisions of this clause (as indicated below) apply to Trader Customers only.
1. The Customer shall have the right to obtain the data generated through the use of the products or related services in a structured, commonly used and machine-readable format. BRITA shall also supply the relevant metadata necessary to interpret and use the data properly.
2. BRITA may use non-personal data exclusively for the following purposes:
1. performance of this agreement (e.g. support, invoicing, warranty),
2. ensuring operation, maintenance, safety and quality of the Product or Service,
3. improving existing products and services,
4. developing new products and services, including data-driven and AI-based solutions,
5. creating aggregated or derived datasets, provided such data does not allow re-identification of the Customer.
Any further use requires the Customer's explicit agreement.
3. If you are a Trader: BRITA shall not use the data to draw conclusions about the Customer's economic situation, assets, production methods or business strategies where such use could cause commercial disadvantage to the Customer.
4. BRITA may share non-personal data with third parties only if:
1. the Data is used exclusively for the purposes listed in Section 2,
2. the third party is contractually bound to apply the same protection and confidentiality standards, and
3. no transfer is made to any undertaking that holds a position of significant market power in a relevant digital platform market.
4. Any broader sharing shall require the Customer's prior consent.
5. BRITA shall implement appropriate technical and organisational measures (including, but not limited to, encryption, access controls and firewalls) to protect the data from loss, misuse or unauthorised access.
6. The Customer may use the data provided by BRITA for any lawful purpose. The Customer shall not:
1. use the Data to develop competing products or services,
2. circumvent technical protection measures,
3. use the Data for unlawful purposes or in breach of applicable safety requirements.
7. If you are a Trader: Where BRITA uses the data for its own commercial purposes or sells the data to third parties, the Customer shall be entitled to proportionate and fair compensation. The details of such compensation shall be laid down in a separate agreement.
8. Both parties undertake to keep all confidential information, including business information and contractual details, strictly confidential and not to disclose it to any third party. Disclosure is permitted only where legally required or where the other party has expressly consented. The confidentiality obligation shall survive termination of the contract.
9. Upon termination of the contract, BRITA shall cease to collect or process any new data. Data collected prior to termination may only be used for the purposes specified in clause 13.2.
14. Customer Service
Customers may contact BRITA at any time with any questions, complaints or claims. BRITA's customer service team can be reached by telephone Mon – Fri 09:00am – 5:00pm on 0800 2794145. BRITA is also available to Customers by email via shop-uk@brita.net and at the following address: BRITA SE, Heinz-Hankammer-Straße 1, 65232 Taunusstein, Germany.
15. Changes to these GTC
We may make changes to these GTC from time to time (if, for example, there is a change in the law that means we need to change these GTC) but the GTC applicable at the time of your order will apply to that order. Please check these GTC regularly to ensure that you understand the GTC that apply at the time that you order products.
If you are a registered user and have a ‘MyBRITA’ account, we will provide you with at least thirty (30) days’ advance notice of any changes to the GTC, unless the change is due to a change in law or for security reasons (in which case we may need to change the GTC on shorter notice). If you do not wish to continue using our services following the changes to the GTC, you do not have to place any further order for a product.
16. Governing Law and Jurisdiction
1. These GTC are governed by the laws of England and Wales. This means that your access to and use of the website and any purchase of products, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), will be governed by English law.
2. If you are a Trader: You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these GTC or their subject matter or formation.
3. If you are a Consumer:
a) You may bring any dispute which may arise under these GTC to - at your discretion - either the competent court of England, or to the competent court of your country of habitual residence if this country of habitual residence is within the UK or is an EU Member State, which courts are - with the exclusion of any other court - competent to settle any of such a dispute. We shall bring any dispute which may arise under these GTC to the competent court of your country of habitual residence if this is within the UK or is an EU Member State, or otherwise the competent court of England.
b) As a Consumer, if you are resident in the UK or the European Union and we direct this website to and offer our products to (and/or pursue our commercial or professional activities in relation to the website and/or products in) the country in which you are resident, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these GTC, including clause 14.1, affects your rights as a consumer to rely on such mandatory provisions of local law.
A. Additional conditions for redeeming promotional vouchers
§ 1 Scope
These additional conditions for redeeming promotional vouchers (hereinafter referred to as “Additional Conditions for Promotional Voucher”) shall apply in addition to the above GTC if the customer wishes to apply and redeem a promotional voucher when purchasing one or more products.
§ 2 Definition of vouchers
Promotional vouchers are discount codes and vouchers issued free of charge, which cannot be purchased by the customer but are issued by BRITA as part of marketing campaigns, and which have a specified period of validity.
§ 3 Redemption
1. Promotional vouchers can only be redeemed during the specified period.
2. BRITA reserves the right to issue such promotional vouchers that are expressly valid for specific products only.
3. Only one promotional voucher can be redeemed per order. It is not possible to combine multiple promotional vouchers.
4. The promotional voucher can generally be redeemed regardless of any minimum order value. In exceptional cases, a minimum order value must be met, provided that BRITA has expressly stated this when issuing the promotional voucher.
5. The promotional voucher can only be redeemed before completing the order process. Subsequent settlement is not possible.
6. The promotional voucher cannot be applied to products that are already reduced.
7. The promotional voucher cannot be applied to products or product groups that are separately marked by BRITA as excluded. The excluded products and product groups will be specified when the promotional voucher is issued.
§ 4 Return of the goods ordered with the promotional voucher
In the event of a cancellation or return under the 30-day extended returns policy granted by BRITA (“money-back guarantee”), the customer will only be reimbursed the amount actually paid (goods value minus voucher value).
The promotional voucher will not be reissued upon cancellation or return and will expire without replacement.
§ 5 Miscellaneous
1. The value of the promotional voucher will not be paid out in cash, nor will it accrue interest.
2. The promotional voucher is transferable. BRITA may make payment to the respective holder of the promotional voucher in a manner that discharges its liability.
§ 6 Supplementary application of the GTC
Unless otherwise stated in these Additional Conditions for Promotional Voucher, the above GTC shall also apply. In the event of any inconsistencies between the GTC and these Additional Conditions for Promotional Voucher, these Additional Conditions for Promotional Voucher shall take precedence – within the scope of application of these Additional conditions as set out in § 1.
B. Additional conditions for the Interval Subscription
§ 1 Scope
These additional conditions for the Interval Subscription (hereinafter referred to as “Additional Conditions of Subscription”) apply in addition to the above GTC if the customer takes out a subscription for BRITA filters and filter cartridges (hereinafter referred to as “subscription products”).
§ 2 Scope of services
1. The Interval Subscription for filters and filter cartridges is a regularly recurring purchase contract in which the customer receives subscription products at the fixed intervals that they themselves have determined.
2. The customer can choose between the package sizes available for the selected subscription product and between different delivery intervals. The available package sizes and delivery intervals are as shown in the relevant product listing in the shop.
3. The contract is established by placing an order in the shop. The customer can select the subscription option on the respective product details page or subsequently activate it in the shopping cart or at checkout, provided that a product eligible for subscription has been added to the shopping cart. A MyBRITA account is not strictly necessary for taking out an Interval Subscription; the subscription can also be taken out as a guest customer. The term and scope of the subscription products to be delivered by BRITA shall be confirmed to the customer once again in the final order confirmation from BRITA.
§ 3 Subscription process
1. The first delivery as part of the Interval Subscription includes the subscription products and takes place on the delivery date in accordance with the order confirmation from BRITA. Subsequent deliveries will be made at the intervals selected by the customer at the time of the initial order until the Interval Subscription is cancelled or otherwise terminated. The interval refers in each case to the dispatch date from BRITA. For example, if the customer has selected a six-month delivery interval, the next subscription products will be shipped six months after the dispatch date of the previous delivery. If a delivery date is postponed in accordance with § 6 or a delivery is skipped, the next delivery date shall be determined in accordance with the provisions set out therein.
2. Ordering an Interval Subscription requires the deposit of a payment method that allows recurring payments (e.g. PayPal or credit card). The debiting of the account for the first delivery takes place after the first order confirmation has been sent. For repeat orders, the account will be debited each time a repeat order is placed. For this purpose, the payment details are not stored in BRITA’s systems, but by the relevant payment provider or subscription service provider. Please refer to Section 6 of the GTC.
3. The customer must ensure that the PayPal account or credit card provided has sufficient funds throughout the term of the Interval Subscription, so that payment can be made before the subscription products are dispatched. During the term of the subscription, the customer must ensure that the information regarding the selected payment method is correct and up-to-date. Changes to the selected payment method, such as the change of a credit card, must be communicated to BRITA immediately. If a payment fails, BRITA will inform the customer of this and give an appropriate opportunity to update the payment details, or to choose another available payment method. BRITA’s statutory rights remain unaffected.
4. If a promotional price has been granted for the first order (for example, by redeeming a promotional voucher or by discounts issued by BRITA) this only applies to the first delivery of the subscription product. BRITA is entitled to offer a voluntary discount on subsequent products as part of the Interval Subscription.
§ 4 Product changes
1. BRITA reserves the right to further develop or improve the subscription products between the individual service intervals. This applies in particular to changes that are necessary to keep the products up-to-date technically and/or legally.
2. BRITA will inform the customer of any product changes at least four weeks before the first delivery of the modified product, and whether the new product remains compatible with existing equipment. In the notification referred to in Section 1, BRITA expressly informs the customer that the change shall be deemed to have been approved unless an objection is raised in writing within two weeks of receipt of the notification, and that, in the event of a timely objection, the customer is entitled to an extraordinary right of termination.
3. If the customer does not agree to a change to the product, they may object to the change in writing (e.g. by email) within two weeks of receiving the notification referred to in Point 2. In the event of a timely objection, the customer is entitled to terminate the Interval Subscription with immediate effect from the date on which the change takes effect. If the customer does not object in a timely manner, the changes are deemed approved.
4. Irrespective of the right to object in accordance with Point 3, the customer can terminate the Interval Subscription at any time in accordance with § 5 of these Additional Conditions of Subscription.
§ 5 Termination of the subscription
1. The customer has the right to terminate the Interval Subscription at any time. Cancellation can be carried out via the designated and clearly labelled option in your MyBRITA account, via the link contained in the order or subscription confirmation, or by sending a notification to this effect (via email, the contact form or the helpline). The Interval Subscription shall be terminated with immediate effect; subscription products already dispatched will not be affected by the cancellation.
2. In the event of cancellation by the customer, the subscription products shall not be returned to BRITA, unless a warranty claim arises and a return is required in that context.
3. BRITA has the right to terminate the Interval Subscription on objective grounds, in particular if a subscription product is no longer available on a permanent basis or if the customer repeatedly fails to meet their payment obligations. BRITA will notify the customer of the termination in good time (at least four weeks) before the start of the new interval.
4. Cancellations of the Interval Subscription are possible at any time in accordance with § 5 No. 1.
§ 6 Changing delivery dates and skipping deliveries
1. The customer is entitled to reschedule the next delivery date within the Interval Subscription (“reschedule”). The delivery date can be postponed by one week, two weeks or any date within the next ninety (90) days.
2. In addition, the customer can skip the next delivery (“Skip”). In this case, the next scheduled delivery is cancelled; the interval will remain unchanged, so that the following delivery becomes the new next delivery. Skipping can be reversed on the subscription details page.
3. In order to exercise the options set out in Points 1 and 2, the customer must log into their MyBRITA account or use the link provided in the order or subscription confirmation. On the subscription details page, the customer selects the relevant subscription and the desired option by clicking the button. Depending on the option selected, further refinement options may be available (e.g. postponing by one week or two weeks by selecting “Reschedule”).
4. The “Reschedule” and “Skip” options are available to the customer as part of their respective Interval Subscription, provided that the subscription remains active. It is not possible to make subsequent changes to deliveries that have already been dispatched.
§ 7 Supplementary application of the GTC
Unless otherwise provided for in these Additional Conditions of Subscription, the above GTC shall also apply. In the event of any inconsistencies between the GTC and these Additional Conditions of Subscription, these Additional Conditions of Subscription shall take precedence – within the scope of application of these Additional Conditions as set out in § 1.
§ 8 Amendments to these Terms and Conditions for the Interval Subscription
BRITA reserves the right to amend or supplement these Special Terms and Conditions at any time with future effect, provided this does not result in any significant disadvantage to Customers. Customers will be notified of any amendments in text form, via the email address they have provided, at least two (2) months before the proposed date on which the amendment is due to come into force. BRITA will include a separate notice informing Customers of the consequences of failing to object within the applicable time limit. Amendments proposed by BRITA shall only come into force if Customers agree to them.
In certain cases, acceptance of an amendment proposed by BRITA may be presumed; however, a Customer's silence shall only be deemed to constitute acceptance of the proposed amendment if and to the extent that (i) the Customer does not object to the amendment proposed by BRITA within two (2) months of receiving the proposed amendment, or (ii) BRITA's proposed amendment serves solely to restore the conformity of these Special Terms and Conditions with an amended legal situation, because a provision of these Special Terms and Conditions (a) no longer complies with the legal situation due to a change in the law; or (b) becomes invalid or may no longer be applied due to a final and binding court decision; or (c) conflicts with a binding order issued by an authority with jurisdiction over BRITA. In such cases, BRITA will inform Customers of the consequences of remaining silent.
Deemed acceptance under clause 8.2 shall not apply to: (i) price changes; (ii) changes to essential contractual obligations; or (iii) changes which would be tantamount to the conclusion of a new contract and which would significantly alter the previously agreed contractual relationship between Customers and BRITA in BRITA's favour. In such cases, BRITA shall obtain the Customer's consent by other means. This clause does not affect a Consumer's statutory rights where these Special Terms and Conditions are varied in a way that is not permitted under applicable UK consumer protection law.
